The backpack pictured here is a derivative work of copyrighted packaging that is obviously above COM:TOO USA and COM:TOO Canada. There is no plausible claim to freedom of panorama for this sort of packaging in the the United States and COM:TOO Canada (one of which this photo was taken per the branding being "Capri Sun" rather than "Capri-Sun"), so this photograph would only plausibly be free if the use of the Capri Sun were de-minimus. The use of the packaging in the work is significanly greater-than-de minimus, as the packaging is the central focus of the image. No. There's (plausible) permission for the thin copyright of the photograph. This is a question is about whether or not the underlying backback, which itself is a COM:DW of the Capri Sun packages, is available under a valid free license. Because the backpack is a derivative work of the packages, and the packages are extremely prominent in the photograph (the point of the photograph is to show the backpack's design, which is composed of a tessellation of Capri Sun packages), we need permission from the copyright holder of the design of those Capri Sun packages.
