  • This picture is old. Really old. I strongly doubt that the Hover foundation or anyone connected to the Hoover Institution took this picture. I'd say that this picture is public domain based on it's age! Also, as it is a picture of Joseph Stalin, I strongly doubt it was taken by anyone but a Soviet Photographer, employed by the Soviet Government, making it public domain. 67.244.223.68 18:40, 29 April 2009 (UTC)[reply]

Kept. Source added. Yann (talk) 18:47, 7 June 2009 (UTC)[reply]

I reopen the DR: the author is Margaret Bourke-White, according to [1]. Yann (talk) 18:01, 14 June 2009 (UTC)[reply]

It looks like this file has to be deleted. Please then also delete the compilation File:AxisTalks Pent.png as it uses the image as well. There may be other compilations using this image. --Denniss (talk) 19:38, 15 June 2009 (UTC)[reply]
This one as well: File:Joseph_Stalin_Colour.jpg. Óðinn (talk) 20:49, 15 June 2009 (UTC)[reply]

Kept. as per Panyd. Yann (talk) 17:43, 28 September 2009 (UTC)[reply]

File:Joseph Stalin.jpg

The OTRS permission is nonsense. It comes from a g-mail account and says that the sender is the son of Bourke-White and that the photograph was taken by his father. It seems unlikely that Bourke-White's son does not know that his famous photographer parent was his mother, not his father.

However, the lack of knowledge displayed by her "son" is not surprising. Bourke-White did not have any children.

More to the point, according to this site, which Yann found above, the photograph was taken while on assignment for Life Magazine and therefore the family does not own the copyright. Since Time Inc. is presumably getting a royalty for its sale as a poster, it seems unlikely that we could get permission.      Jim . . . . No idea why Hungarian copyright law should be relevant for this photograph. No author listed (and the given source is wrong, [2] was probably meant instead). Mormegil (talk) 13:00, 28 May 2013 (UTC)[reply]

OK! Source: 6. page, and PD-old. Tambo (talk) 13:28, 28 May 2013 (UTC)[reply]
PD-old? Who created the photograph so that you are sure he/she died before 1942? Or, do you mean something like {{PD-anon-70}} or {{Anonymous-EU}}? And you believe the author of an official photograph is unknown? (And see also Commons:URAA-restored copyrights.) --Mormegil (talk) 08:14, 29 May 2013 (UTC)[reply]
Comment Most likely was made after 1942. Shoulder marks were made as Soviet army uniform at the end of 1942-beginning of 1943. --EugeneZelenko (talk) 14:50, 28 May 2013 (UTC)[reply]
  •  Delete Points to consider:
  • Note that this is not the same image as the Margaret Bourke White image deleted above.
  • The source site has an explicit copyright notice (which may, of course, be copyfraud if the image is actually PD).
  • The description given on the image is quoted from the source site and is clearly a copyvio, which suggests that our uploader does not understand copyright.
  • Given the internal evidence that it was taken after 1942 it is still under copyright and will be until URAA runs out.

  •  Delete The page doesn't tell where the image comes from. For example, it might previously have been published in a book or a newspaper with a photo credit. For that reason, we can't tell whether it is anonymous or not, and we don't know whether the photographer died before 1943 or not. Also, COM:URAA requires that the photographer died before 1946, but we don't know whether this is the case either. --Stefan4 (talk) 14:09, 29 May 2013 (UTC)[reply]
  •  Comment We have two very different photos, one that was uploaded in 2008 and one that was uploaded just before this DR started. If the old one is the Margaret Bourke White image, then those images need deleted. Otherwise these need separated and handled separately.--Prosfilaes (talk) 23:07, 29 May 2013 (UTC)[reply]
