- This advertisement is in the public domain, and I'll argue why here. First of all, this is an American ad in an American magazine created by and/or for an American company for a video game developed in the United States.
Copyright notice was required for all works first published before March 1, 1989, subject to some exceptions discussed below.
- Advertisements featured in magazines required their own copyright notice.
A general notice for a collective work as a whole covers the separate contributions that it contains (regardless of ownership), except for any advertisements inserted on behalf of persons other than the copyright owner for the collective work.

- This work does not have a copyright notice. However, for works published between January 1, 1978 and March 1, 1989 (which is the case here) there were a few ways to still have some claim over the copyright:
1. The notice was omitted from no more than a relatively small number of copies or phonorecords distributed to the public.
- For obvious reasons, this cannot happen with magazine ads.
2. The work was registered before or within five years after the publication without notice and a reasonable effort was made to add notice to all copies or phonorecords distributed in the United States after the omission was discovered;
- The advertisement was never registered with the U.S. Copyright Office, and later copies (Family Computing, February 1984; Personal Software, March 1984; Compute!, June 1984/Compute!'s Gazette, June 1984) also feature the absence of a copyright notice.
3. The omission violated an express written agreement to include proper notice as a condition of public distribution of copies or phonorecords; or,

- Artwork made specifically for an advertisement is covered by the advertisement itself, it does not have its own copyright status. Regarding the inclusion of copyrighted elements, it is valid to say that they have fallen to the public domain if they were included with the consent of the copyright holder (which they were, Epyx was the publisher of the title). A notable example of this is this newspaper advertisement for a exhibition of Cabaret (a film originally released on February 13, 1972) that features Liza Minelli making her iconic pose to take place on May 12, 1972. Freedom of panorama is an exception for the copyright provided to architecture and statuary. The art and the building are not one-and-the-same. This is not a photo of a building in the normal use of the phrase. In fact, absent the attached mural, no one would be able to identify where a simple brick wall was photographed. The underlying building was built decades ago and it not the work of the identified artist. Besides, even as a photo of a mural, the image is a unique combination of related, distinct elements. The fact that the building is a public library is amplified by the fact that it has a mural representing shelves of books AND also by the bike rack that spells out BOOKS. Per prior consensus stamps (or other payment documents) in Russia are non-eligible for copyright but only as a whole subject. When they are cropped, they become covered by copyright protection. In this case the image is cropped from an otherwise PD postal cover. To quote the law in Russia, "“This Russian official document, state symbol or sign (postage stamps, coins and banknotes mainly) may incorporate one or more works that can be copyrightable if separated from this document, symbol or sign." So the image is covered by copyrighted since it is separated from the original document.
