Commons:Freedom of Panorama 2015
We have until Thursday 9th July to convince MEPs (Member of the European Parliament) to stop or amend the following text, that the European Parliament is considering in a report of the Commission of Juridical Subjects on the implementation of the Directive 2001/29/EC on author's rights in the society of the information:
16. Considers that the commercial use of photographs, video footage or other images of works which are permanently located in physical public places should always be subject to prior authorisation from the authors or any proxy acting for them;
There are two ways to stop this text becoming part of the adopted European Parliament report:
- Delete the whole passage and have the final version not mention FoP at all.
- Change the text to say something that would not hurt us.
Either way, we need to find 75-76 MEPs (10% of the house) until 1 July to sign up to an amendment proposal so it can be voted on in plenary.
UPDATE:
- We have managed to find enough MEPs from various groups to file a positive amendment affirming Freedom of Panorama. The signatures were collected with the help of mainly the Dutch, German and Estonian ALDE members.
- As a result of the big pressure we exercised and the fact that his own group publicly opposed him on this, Mr. Cavada has now called everyone in the European Parliament to vote to delete his wording, but also to oppose the amendment, as a compromise. It looks like there is a solid majority for this compromise.
- Delegations form the second largest group, the S&D, have taken public positions against the Cavada text. They have however also let us know, that they wouldn't appreciate being cornered into voting for new (ALDE) amendment. The reasons they cite are mainly of procedural nature.
- It would take a lot of pressure to get the positive amendment through. Such an aggressive campaign pushing for the absolute maximum this early on in the legislative process could, I am afraid, hurt our standing. Especially banners are only effective if they are used conservatively and there is an imminent threat. This threat is not given any longer, which we should all congratulate ourselves for. This is something we achieved! I want to personally thank each and every single one of the hundreds of people who worked on this.
- We can still push for the positive amendment by ALDE! We can do this by writing and calling our MEPs personally and ask them to vote for it. We can also do this by joining the petition, which will ask all its signatories to to do the same.
- What we can and should do now is invest in the contacts we established with MEPs and their assistants. Thank the ones who answered and promised to help! Invite them to a Wikipedia meet-up! Offer you expertise! Ask them to help you with FoP on the national level if you have none!
- Maintaining contacts is also important, as the copyright reform dossier will come to the European Parliament sometime next year. If we make friends now, it will make our lives much easier next time around.
- The vote on 9 July will go down as follows: First the positive amendment by ALDE will be voted on, then after that the "split" (meaning deletion) of the FoP paragraph. If the positive amendment passes, we would need the deletion to be rejected. If the positive amendment is rejected, we need the deletion to get a majority.
Today 9 July, the European Parliament voted about the copyright report, including the subject Freedom of Panorama.
- The negative text by Cavada (Freedom of Panorama only non-commercial in whole EU) was dropped by 502 to 40.
- The positive text by Schaake (full Freedom of Panorama in whole EU) didn't pass by 228 to 303.
- The report as a whole was accepted with 445 to 65 with 32 abstentions.
Thanks everyone, we almost manage to achieve a full swing, which is a very tough feat to get done in 3 weeks.

- The SOPA/PIPA blackout of Wikipedia was an amazingly effective piece of online campaigning. Blacking out all {{FOP}} images for a day would be really effective, even if only on EU-national-language wikis.

- Actually, a proportional reaction would be not a general blackout, but a blackout of images. On the other hand, in the countries without FoP, non-commercially permissible images are uploaded locally, so we'd need a technical support in local Wikipedias, as Commons would not suffice. --Oop (talk) 09:15, 22 June 2015 (UTC)

- A clear statement from WMF that, as a non-EU corporation with no staff inside the EU, we will not adhere to the proposed FOP restrictions would be very newsworthy.
- I sincerely doubt WMF would do that. They're trying to be legally as correct as possible, and statements like "we're going to ignore your laws" might jeopardize the whole project. --Oop (talk) 09:15, 22 June 2015 (UTC)

Try to find out if the Committee for Culture and Education could help by publishing an "Opinion"(see talk page for details)- Work with other interested groups — members of EDRi, for instance. Open Rights Group (GB) have already been informed, but so should other EDRi members and equivalent organisations across the EU — La Quadrature du Net (FR), Chaos Computer Club (DE), Digital Rights Ireland (IE), Bits of Freedom (NL) for example — and organisations like Creative Commons.

The title must be something that the readers easily understand and all would agree with. For the moment, the best I can come up with is: "Photos of modern buildings must remain on Wikipedia". The line below should explain what is going on. First suggestion: "A proposal in the European Parliament brings thousands of images on Wikipedia in danger." Please give suggestions for improvements! MEP contact information
[edit]How about we try to make it easy for people to find their MEPs contact information? Also, we should create a list of important MEPs. What I mean by important - those that are in the right commissions, etc. I was reading some related forums (in Polish) and some people say that some MEPs are much more important to contact then others. - for maximum impact please contact each of your local MEPs and ask them to communicate your concern to the MEP responsible for co-ordinating their group position on the matter—in the UK, for example, this would be Sajjad Karim (on-side?) for the Conservatives, or Mary Honeyball (wobbly?) for Labour

He is supportive of our arguments and said that Labour MEPs do not support the part of this report dealing with Freedom of Panorama, and are tabling further amendments. ... - Sabine Verheyen, German MEP, speaker for the EPP (EVP) group in the EP committee for culture (CULT), today wrote in her reply to my mail from June 18th, that her group (EPP/EVP) intends to "protect artists of work in public space from commercial use of their works with prior authorisation". This is exactly the position of MEP Cavada. She also wrote that the Legal Affairs committee considers the restriction to non-commercial of photos of works permanently installed in public space an European solution for the differences between national rules for freedom of panorama. I thing I am going to contact here next week, trying to convice here that, what she considers a protection for artists, in reality is a huge downturn for the vast majority of the creative industrie, because without FoP even architects wouldn't be allowed to publish photos of their works in an urban envirement, when any other building is visible. // Martin K. - in paragraph "It is not the public space that enters the author’s atelier.", I think that the original meaning is as such :
- "the author" is appropriating public space to make it its atelier.
- Your translation changes slightly this meaning in (in my opinion/interpretation) :
- "public space" is invading author's atelier, making it public too, and robbing the author of its rights.

- --Glavkos I wrote a message to D. Papadimoulis, Greek MEP on EU Parliament. I am willing to write e-mail letters to all Greek and Cyprous MEP's until the end of the month. We have an ongoing discussion on that in the Greek Village Pump.
- Update: I got a response for MEP D.Papadimoulis that he will get informed about the issue and I send additional links to him. Today also I send hard copies (about 15) to all Greek and Cyprian MEP's on Euro-Parliament (the selection includes all the political parties that are represented there). I will start the email campaign next week, as we have time for that. A public letter is a very good idea and I will try to involve in that the el.wp community the next days.
