I challenge the De minimis statement concerning the glass pyramide. It is hardly conceivable that such an integral artwort could be de minimis as it is always style-defining for the building. Hence, it never could be "accessory compared to the main represented or handled subject" and never could only unintentionally included as long as the whole of the pyramide is shown.   •  Comment: Well, Denniss said in the DR from 2012 that it was "a borderline decision". But there's some new legislation in France, with a noncommercial FOP exemption. I think per COM:PRP that it could open the way for a court to tend towards the side of "illicit work reproduction", as there's a clear allowance for commercial usage on Commons. As far as I understood the French court rulings linked in COM:FOP#France, the inclusion of a protected work must be spurious to be legit.
